Notice that by these guidelines, you can be arrested for DV for pretty much anything. On the father's rights front, I call this the eject the husband call or in the case of Rep. Geoff Simpson (D-Covington), the fun things that can happen when dealing with your crazy ass exwife.
Notice also that by the same guidelines, interfering with a court ordered child visitation defined and scheduled in a parenting plan is domestic violence. However- good luck getting the police to respond and make an arrest or even document it- so you can force the issue in court.
This is what happens when your county sheriff is funded with big fat wads of cash from the violence against women act. It's ironic that the police can always find Geoff Simpson's wife, but they couldn't find the woman who testifies against shared parenting at the legislature each year because she was allegedly locked in a basement off and on for 9 years.
Question #1 – Is there a crime?
Do you have Probable Cause?
Are all the elements of the crime(s) met?
Who is the Primary Aggressor?
Here are the most common DV crimes:
Assault
Harassment
Violation of court orders
Malicious Mischief
Interfering with reporting of DV
Question #2 – Is it a Family/Household Relationship (as defined by RCW 10.99.020)?
Now or at any time in the past;
Any one of the following connections:
Child in Common (any age)
Married (any age)
Parent-child / grandparent-child / step-parent-child (any age)
Adult roommates (18 y.o.)
Related by blood or marriage (18 y.o.)
Dating (16 y.o.)
Question #3 – Is it a Mandatory Arrest?
All of the following criteria must apply:
Family/Household relationship, AND
Occurred within the last four hours, AND
The crime was assault, threat/fear of assault, vio of court order, AND
Suspect is 16 or older
